When you donate to an eligible charity you may be entitled to a charity tax deduction. Below find out how to determine tax-deductible charities in Australia, what the donation tax deduction limit is and how to receive a charitable donations tax deduction when you donate to our charity.

Tax-deductible charities in Australia

Not all charities are tax-deductible charities in Australia. A charitable donations tax deduction can only be made if the charity you have donated to is endorsed and registered as a deductible gift recipient (DGR). To be endorsed as a DGR there are specific requirements that the charity must meet. You canTo find out what charities which are the tax- deductible charities in Australia use in the ACNC Charity Register.

Charitable donations tax deductions can also only be made if, in addition to the charity being a DGR, the following three conditions are met:

  1. The donation is a genuine gift, which means you cannot benefit from the donation (e.g. receiving or expecting to receive something in return)

  2. The donation must be money or property

  3. The donation must comply with any relevant gift conditions – as outlined on the ATO’s website, sometimes the income tax law for a DGR may add extra conditions affecting the types of deductible gifts they can receive

You may be able to claim charitable donations tax deductions for the following:

  • Monetary donations of $2 or more

  • The property the ATO values at more than $5,000

  • Property under the Cultural Gifts Program

  • A heritage gift

Donation tax-deduction limit

In regards to the donation tax deduction limit in Australia, the amount you can claim depends on the type of donation you have made. However, there is no set donation tax deduction limit as such however, the deduction you are claiming cannot add to or create a tax loss. Your donation deduction can reduce your assessable income to nil in the tax year your donation was made but you cannot claim any excess. You do have the option of spreading the tax deduction for up to five income years if you cannot claim the total amount in that tax year.
